NOTICE: It is your responsibility to carefully read these Terms of Use (“Terms”) prior to using our site or purchasing and or accessing any of our services. These Terms govern and define your use of the Site and Services and are legally binding.
This website, spuryoursavings.com (“Site”) is owned and operated by Spur Your Savings Money Coaching Corp, incorporated and operating under the laws of Saskatchewan, Canada. In these Terms of Use (“Terms”), “we”, “us” “coach” and “our” refer to Spur Your Savings Money Coaching Corp, and the terms “you” or “your” or “client” refer to any individual user of our Site.

USE OF OUR SITE AND SERVICES
When you accessed our Site or opted-in to any of our Services you were given reasonable notice that these Terms existed. By accessing and continuing to use our Site or by clicking to accept or agree to these Terms when the option is made available to you, you agree to be legally bound and abide by these Terms and our Privacy Policy whether or not you have read them. If you do not agree with these Terms or our Privacy Policy, you must not use or access our Site or Services. By using our Site or by clicking to accept these Terms of Use (“Terms”), you accept and agree to be bound by and comply with these Terms as well as our Privacy Policy. By purchasing or accessing any of our Services, you further warrant to us that is the applicable age of majority in your jurisdiction to enter into a contract with us. If you are using this Site on behalf of your employer, you guarantee that you have the authority to bind your employer to the Terms. If you do not meet these requirements, you must stop using our Site.
We cannot guarantee that all content on our Site is entirely accurate, complete, or up to date. We reserve the right at any time to modify or discontinue, in whole or in part, any Services offered or change the prices of Services without notice. 
We are not liable to you or any third party for any modification, price change, suspension or discontinuation of any Services. If you wish to have any of your personal information and/or access to our Site removed, you may email us at genie@spuryoursavings.com and we will make reasonable efforts to do so. 

Fees
Fees are as listed on our Site and in [CDN/US] dollars. We reserve the right to change our Fees at any time and without notice.
Refunds
We do not provide refunds.
Method of Payment 
Client agrees to render payment via Stripe or credit card and understands they will be charged in the amounts outlined above, on the corresponding due dates of each installment payment. Should the appropriate method of payment change at any point during the above outlined schedule, Client agrees he/she will promptly notify Coach and/or Coach’s Team to ensure payments are not missed.
 Missed / Failed Payments
Should Client fall behind in payments, or if additional payments are not able to be processed, Client understands: (1) Client will have a seven (7) day grace period to make the required installment payment upon receipt of invoice; (2) Client will owe a late fee of 5% of the payment, should Client fail to make the required payment after the 7-day grace period has expired; (3) the remainder of the Program may be forfeited if payment is not made thereafter.
Coach reserves the right to cancel or stop working with Client should he/she become unable to make the additional payments in accordance with the Payment Schedule outlined above. Should this occur, Client understands she is not entitled to a refund of funds already issued to Coach in exchange for work completed thus far, and it is up to the sole discretion of Coach whether Client is to have continued access to any materials made available to Client during the Program up until payments were missed. Thus you expressly agree to forfeit materials or resources provided to you in case after the 7-day grace period has expired. 

Digital Product Licensing
When you purchase or opt-in to any of our digital products, services or other resources (collectively “Digital Products”), you do not obtain any ownership interest or other rights to the Digital Products and all ownership in the Digital Products remains with us. By purchasing or opting into Digital Products you receive a limited, non-transferable, non-exclusive, revocable license for non-commercial use only in order to access our Digital Products and Content. As a condition of your use of any materials provided to you, you may not, under any circumstances, reproduce, copy, modify, sell or use such materials except as it was originally intended when it was provided by us to you, including sharing with any third-party. If it is determined that you have breached this limited license, this will be considered infringement of our Intellectual Property rights and we specifically reserve the right to invoice you for any licenses you have sent to others, seek damages, an injunction, and/or any such other available legal remedy in our sole discretion.
As part of your limited, non-transferable, non-exclusive royalty-free license you may (i) access the Services for your personal use or use in your business for non-commercial purposes; (ii) download or print any of the materials provided to you as part of the Services for your personal use or personal use in your business only.
For clarity, as a condition of your limited license you may not:
(i) re-sell, distribute or trade your access or passwords to access the Digital products and Content;
(ii) share the Digital products and Content with anyone else who has not yet purchased it or opted in to receive it;
(iii) republish any of the Digital products and Content, in part or in whole;
(iv) distribute any of the materials contained in the Digital products and Content; or related materials and/or communications as your own;
(v) use the Digital products and Content; in whole or in part or make minor changes to any part or whole of your purchases for resale, sharing or distribution as your own work;
(vi) claim ownership or use over any of our intellectual property, including but not limited to our Digital products and Content; without our prior consent, which includes (but is not limited to): copyrights such as downloads, resources, courses, workbooks, lessons, videos, and more; trademarks such as names, logos, taglines, or other unique source identifiers; or trade dress including the look and feel of any of our Digital Products or other offerings (and its related communications and materials); or
(vii) use our Digital products and Content; or Intellectual Property in any related materials and/or communications in an unlawful way or for any illegal or unlawful purpose(s).
Violations and Indemnity
We take violations and infringement of our Intellectual Property rights seriously. We expressly reserve the right to take whatever legal steps necessary to protect and defend our Intellectual Property, and violators will be prosecuted to the fullest extent permissible by law. You agree to indemnify, defend and hold us harmless for any and all damages, costs and expenses, including legal fees, arising from your misuse of our Intellectual Property and our enforcement of our rights.

Security & Confidentiality
Despite our commercially reasonable efforts to protect your data, we cannot ensure the absolute security of your personal information transmitted to our site - such transmissions are at your own risk. We cannot be held responsible for any evasion of any privacy settings or security measures we have in place on our site.
Should you be required to create a username and password for access to any services, you are responsible for protecting them from theft or unauthorized use. In the event of a breach, you must notify us immediately by emailing genie@spuryoursavings.com.
Our site and services use a number of third-party applications for payment processing, electronic newsletters, and booking systems. For information on how your personal data is collected, stored, and processed, please refer to our Privacy Policy. You are responsible for reviewing the terms of use for these third-party applications. If you disagree with their terms, you are advised to stop using our site and services immediately.
We do not owe any duty of confidentiality to you, unless explicitly stated, as in a subsequent client agreement or as mandated by law or fiduciary duty. You acknowledge this lack of duty of confidentiality by accessing our site. 
Your communications with us may be subject to viewing and/or distribution by third-parties. We own any and all communications displayed on our website, servers, comments, emails, or other media as permitted under law and will not pay royalties for unsolicited user-generated content such as blog comments or emails. 
By submitting a comment, photo, video, or other materials to our site or any other platform owned or maintained by us, you grant us a non-revocable, commercial license to re-publish your submission, in whole or in part, unless you explicitly state otherwise. We hold the right to republish any communication or submission, in whole or in part, as reasonably necessary in the course of our business. 

Prohibited Behavior & Liability
By using our Site, you agree not to misuse or tamper with our Site, including but not limited to hacking, introducing viruses, trojans, worms, logic bombs, or other technologically harmful material. Any such breach will be reported to law enforcement authorities. You agree to indemnify, defend, and hold us harmless from all third-party claims, liability, damages, and/or costs arising from your misuse of our Site or breach of these Terms.
We reserve the right to block your access to our Site and Services if we deem your behavior inappropriate.
Assumption of Risk & Disclaimers
The use of this Site is at your own risk. While we host our site on a reputable platform and make commercially reasonable efforts to maintain and host the Site, we make no representations, warranties, or guarantees as to your individual safety when using our Site.
We make no warranties as to our Site, the Services, or any related materials. You agree that our Site and Services are provided “as is” and without warranty of any kind either express or implied. We expressly disclaim all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
You acknowledge and agree that we are not liable for any defamatory, offensive, or illegal conduct of any other third-party participant or user, including you.
We strive to provide you with modern, reliable technology, software, and platforms from which to access our Site and Services. Spur Your Savings Money Coaching Corp. does not provide medical, legal, investment, or other regulated professional advice. We are not acting in any professional capacity, including medical, legal, investment, or otherwise during the course of any Service. No part of our Site, the Service or any related content or materials should be construed as medical, legal, or investment advice. We expressly disclaim any responsibility for any actions or omissions you choose to make as a result of using this Site and/or Services.
As a money coaching service, none of the information provided on this website, during coaching sessions, or within any resources made available, is intended as regulated financial advice, a recommendation regarding the suitability of any financial product or investment strategy, or a promotion of financial services regulated by specific governing/ regulatory organizations.
Spur Your Savings Coaching Corp does not employ financial advisors, and thus does not provide any regulated financial services that require authorization or regulation under any regulatory organization. Any decisions made based on the information provided are the sole responsibility of the individual. It is recommended that financial product or investment strategy should always be sought from a qualified and regulated financial adviser.
Third-Party Contributors
Content provided on our Site may be written by third-party contributors. While we are committed to ensuring our contributors are qualified and reflect our values, we cannot guarantee the quality or accuracy of their content. All written content on the Site is opinion and should not be interpreted as our view or as specific advice. We are not liable for any third-party contributors’ content or opinions. LIMITATION OF LIABILITY AND INDEMNITY

DISPUTES AND CLAIMS
Client understands that all services provided by Coach in connection with the Program being purchased are provided on an “as is” basis, meaning it is without any guarantees, representations, or warranties, including but not limited to warranties relating to quality, non-infringement, fitness for a particular purpose, merchantability, or expectation or course of performance. Client is choosing to purchase this Program and work with Coach on a purely voluntary basis and does not hold Coach responsible should Client become dissatisfied with any portion of the Program.
Client agrees that he/she does not have a cause of action, legal remedy, and is not entitled to a refund should he/she not achieve the results desired following completion of their work with Coach, as long as Coach delivers the Program as described in signing contract or similar substitutes.
Client agrees not to file any legal action against Spur Your Savings Money Coaching Corp without first submitting a detailed description of dispute or claim at genie@spuryoursavings.com ("Dispute"). The information provided should include the nature of the issue, references to any governing legal authority and any other information relevant to resolving the issue.
If a dispute cannot be resolved informally or through mediation, litigation may be initiated in the courts of Saskatchewan, Canada. Both parties agree to the exclusive jurisdiction of these courts and will not bring disputes in any other court or adjudicative body. Each party hereby consents to venue and personal jurisdiction in such courts and irrevocably waives any right to assert that such forum is not convenient.

Jury and Class Action Waiver 
YOU WAIVE THE RIGHT TO A TRIAL BY JURY, TO PARTICIPATE IN A CLASS ACTION, OR TO SEEK REMEDIES BEYOND THE EXTENT NECESSARY TO PROVIDE INDIVIDUALIZED RELIEF. YOU AGREE NOT TO ACT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED OR DE FACTO CLASS OR REPRESENTATIVE PROCEEDING, OR AS A PRIVATE ATTORNEY GENERAL OR ON BEHALF OF THE GENERAL PUBLIC.
 Time Limitation 
Any Dispute(s) must be filed within two (2) years after the cause of action arose and you waive any statute of limitations to the contrary. 
Injunctive Relief 
Your breach of these Terms is likely to cause immediate and/or irreparable harm to Spur Your Savings Coaching Corp. As such, we may seek injunctive relief against you without the need to post bond. 
Full Agreement 
You acknowledge that these Terms of Use, together with our Privacy Policy constitute the full agreement relating to your use of the Site and Services.
 Governing Law, Jurisdiction; Legal Fees 
These Terms as well as our Privacy Policy are governed by and interpreted in accordance with the laws of Saskatchewan and the federal laws of Canada where applicable. Any disputes arising directly or indirectly from this Agreement will be submitted and heard exclusively in the courts of Saskatchewan, Canada. Subject to applicable law, the substantially prevailing party in any dispute litigation regarding any Disputes(s) will be entitled to recover reasonable legal fees and costs, including expert costs. 
Waiver 
The failure by us to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Any waiver of these Terms by us must be expressly stated in writing.
All Rights Reserved 
We reserve the right to update and modify these Terms at any point. It is your responsibility to review these Terms periodically. The most current version of our Terms can be reviewed at any time by visiting this page. Any purchase will be processed by one of the following third-party providers: Paypal, stripe, honeybook, quickbooks payments. In order to purchase or access certain Services, we may require you to create a user account and provide your name and/or email address and create a unique password. For your security, we do not have access or knowledge of your password and it is your sole responsibility to keep the password confidential and not share your account details with any other people, including us. Computer, Browser and Mobile Information: Computer and connection information such as statistics on your page views, traffic to and from the Site, your unique resource locator (“URL”), advertisement data, your internet protocol (“IP”) address, your browsing history, and your Site log information. If you access our Site via your mobile phone, we may collect information about your device, including but not limited to, the model, manufacturer, device identification and your location information. Social Media Information: We may access personal information from social networking sites and apps, including Information but not limited to, Instagram, Facebook, LinkedIn, YouTube, and Twitter which may include your name, username on any of these platforms, location, email, age, gender, profile picture and any other public information you have included on any of your social media profiles. If you want to limit this data, you should review their privacy and security settings of each social media site and change your privacy settings. We will not request sensitive information from you at any time. Please do not submit any sensitive data to us, including your social insurance or security number, health data, genetic data, or information related to your ethnic origin, religious beliefs, or criminal history. If you do send us this information, then by doing so you are consenting to our use, storage, and processing of this information in accordance with this Policy.

Spur Your Savings Money Coaching Corp collects information you voluntarily and manually provide when you use our Site and our services (including google sheets forms), such as when you purchase or access Services, sign up for our email list or newsletter, submit a form, send us questions, or interact with us through this Site such as when you provide comments or feedback.

We collect information that is sent to us automatically from your website browser or mobile device, such as your IP address, the name of your operating system, the name and version of your browser, date and time of your visit, page(s) you visit and length of time you spent on each page. The information we receive may depend on your browser or device settings. Information received from your website browser and mobile device typically is not, in and of itself, personally identifiable.

We at Spur Your Savings Money Coaching Corp are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as expressly set out in this Privacy Policy. In compliance with Canada’s anti-spam legislation, the CAN-SPAM Act of 2003 (Public Law No. 108-187) and the California Consumer Privacy Act of 2018 (“CCPA”) all e-mails sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you can opt-out of further e-mail communication from us and will contain an “unsubscribe” link at the bottom of each email. Use of Information

We generally store your data and transmit it to a third party for processing. However, to the extent we process your data, we do so to serve our own legitimate business interest. Generally, the purpose of collecting your information is to:Provide our Site and its contents to you;

Even though we do not disclosure your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

We hold your information only for the duration required to deliver our Services, meet our legal obligations, or until you ask us to erase your information. Any unnecessary information will be permanently erased.
 Your data may be transferred and stored on servers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from your jurisdiction. We will implement all necessary measures to ensure that your data is protected and in compliance with this Privacy Policy and no transfer of your personal data will happen to an organization or a country unless there are sufficient controls in place. 
We use third-party processors to manage your data. For our business operations, we need to transmit certain information to third parties. For instance, when you buy a service from Spur Your Savings Money Coaching Corp your payment information is transmitted to and collected by a secure and recognized third-party payment processor. 
As email is not deemed secure, please avoid sending us payment information via email. Doing so is entirely at your own risk. We use software programs to monitor network traffic to detect unauthorized attempts to upload or change information or leverage hacking attempts or other harmful actions on our Site. While we take these precautions to protect your personal information as much as we can, no system or transmission of data over the internet or any other public network or any storage of data can be guaranteed to be 100% secure.

In the unlikely event that customer data has been lost, stolen, or potentially compromised, our policy is to alert our customers via email no later than 72 hours of our becoming aware of the event. We will also report such incident to any required data protection authority. We will work closely with any customers affected to determine next steps such as any end-user notifications, needed patches, and how to avoid any similar event in the future.



YOUR RIGHTS
At Spur Your Savings Money Coaching Corp, we respect your rights regarding your personal information and data. As per the laws applicable, you have the right to access, correct, request restriction or deletion of your information, or request how we use your personal information and data collected.
Actions include: 
Request a confirmation of what data we hold about you, the purposes for which we hold it, and whether we deliver your data to a third-party processor.
Request that we delete all data that we hold about you, and we must delete such data without undue delay.

If You reside in California, you have the right to obtain from us, once per year and free of charge, information regarding what information we disclose to third-party marketers, and the names and addresses of each third party to whom we disclose your data.
